Legal Question in Family Law in Texas

Father in Contempt, want child back

In May I agreed to joint custody due to financial problems. My ex was court ordered to give me my child every other weekend, and has only let me have her three time in 7 mths. Now I find the new step mother is hitting my daughter and they wont let me see her at all. He says he is calling the shots and doesn't care about the court order and wont let me talk to my girl either or see her. My daughter called from school and is very afraid of this woman. Dad is in AK 3 weeks a mth, and know the woman is abusing my child. what can I do to get her back? I have never hit either of my children and this was only so he could take care of her financially. everything was a lie, and he has 18 counts of contempt from not giving her to me as ordered. what can I do to get my child back and go back to original divorce decree? She is in misery and cries non-stop for me. the stepmom put her in counsuling and tells them i abused her. I have a 24 yr son that can attest that I have never abused either of my kids in any way. my daugher is 13 and very afraid of them both how can I get he away from them? Can I keep her and call CPS on this woman who is unfit to have my child, plus her Dad isn't even there. what can I do to get her back?

You are going to have to find a good lawyer and go back to court to enforce and/or modify the present order. Through your attorney you can present evidence of what you are saying. You didn't say how old your daughter is, but she can testify herself or perhaps through a psychologist. This will take a significant expenditure and a lot of hard work. Good Luck.
