Father wants custody

My husband's was never married to the mother of his 11 year old daughter. The court awarded custody of the child to the grandmother when the child was 6 because the step-father of the child beat her and she had to be hospitalized (he is still in jail). My husband was in Kosevo at the time, and came back during the whole mess on emergency leave. The court was supposed to send someone to inspect his home and no one ever came. Next thing he heard the grandmother had cusody, and he started paying child support. Later we found some paper work that the court had been sending that his now ex-wife had been hiding. My question is, if he wanted to go back to court to get custody of his daughter, would he have a chance of being granted cutody?

Yes. His parental rights are not limited by the fact that they were not married, but according to what is in his daughter's best interest. He can file for a modification of the conservatorship order, and needs to retain an attorney.
