Legal Question in Family Law in Texas

Can Father give Guardenship of a Child's Mother to Girlfriend?

My mother was involved in a carwreck in '93. She has a brain injury from it. She has to have 24/7 care. My father has guardenship of her. My father has a girlfriend of three years and he was diagnosed with liver and pancreatic cancer and given less than six months to live. He wants to have guardenship given to his girlfriend of MY mother. I have a family of my own to take care. But, my parents are MY responsibilty. I know only a judge can grant guardenship of someone. But, could the girlfriend get guardenship of my mother? This is tearing me into. My father has money and I know he probably will have his honey to have power of attorney over him. Can I stop all of this? What rights do I have to stop her from calling all the shots with MY family???

You could apply for guardianship of your mother or you could contest the guardianship given to the girlfriend. A power of attorney to the girlfriend could only be contested as to the powers granted in the POA. The POA creates a fiduciary duty from the girlfriend to your father and any excess of those powers could be contested in your position as a person interested in your father's estate.
