Legal Question in Family Law in Texas

The father of my 4 month old daughter has abadoned us and I would like to change her last name to my maiden name. I want to do this to make it easier when she goes to school that we have the same last name, and he is not a part of her life anymore. What can I do? He told me he would not let me change her name and he hasn't been apart of her life so I don't see how he has the right to say that.

You will file a petition the court, have him served, and set it for hearing. If he appears at the hearing, you will both present your evidence, and the court will issue a ruling.
