Father seeking custody
I'm trying to seek sole custody of my 3 children.My wife refuses to go to mediation.We have 3 children together,ages 5,6 and 1 year. My wife was pregnant when the temporary orders were established.My temporary orders have the names of my 5 and 6 year old but has unborn for the child she was pregnant with.She has hidden the baby from me and has even went as far as accusing me of sx ab of my 5 and 6 year old.This report came back that the children were never touched.She has tried everything in the book to keep me from seeing my children.We went to court for a motion to modify the temporary orders but the judge only met with our attorneys because he said he didn't have enough time to listen to all of the witnesses and re-scheduled.The judge did however strongly urge my wife's attorney to arrange to let me see my 1 year old.Her proposed arrangement is to let me see my 1 year old after I bring my other two children home for 15 minutes outside in our yard were she has to be present.My wife is now 6 months pregnant with her boyfriend's baby.I want to know if I managed to take my 1 year old if I would be in violation of my temporary orders?I've never been in any trouble with the law even though I'm being treated as a criminal.

I agree with Mr. Grissom. Additionally, do not take action outside of the orders, like snatching your child. You are embroiled in a very complex case, and you should be confiding in your attorney. Since taking the high road has not served you well, you may want to have your attorney to take a more aggressive approach. You should be prepared to pay accordingly for the increased time and effort.

Keep forcing mediation. Her failure to attend mediation will not sit well with a judge who does not like family law hearings. (They can be a pain). This might be effective for you to get what you are looking for, but don't get your hopes up. Men seldom get primary custody of the children.
