Based on what you have written and dependent upon the specific terms of the court order governing child custody, support, and visitation; if your sons are living with a sex offender, then you may have the ability to obtain custody. Generally, most courts will not put someone in jail for a first time violation of paying child support.

You should consider consulting with a local law firm to assist you with protecting your and your sons rights and interests. If my local law firm can assist you with this legal issue or any other legal matter, please contact us at [email protected] to arrange for an initial consultation.

Jeffrey had an excellent answer.

1. The mention of a registered sex offender is a red flag for me. If you can prove it, then you might get custody.

2. You need written proof of all money to her. Paperwork is a man's best friend.

Good luck!
