Legal Question in Family Law in Texas

fathers rights

I am in the midle of a custody modification of my 13yr old, my ex-husband has not been seen or heard from in over 7 months when he found out he may have to pay child support. If he comes back around do i have to let him see or talk to our child? Are the old papers that give him custody still valid while this modifcation is going on? He has already signed his rights away to his other 2 children from other women and is a drug user and has an unstable job history.also as far as i know there are no papers giving me temp. custody, should there be some? i started this approx. 2 years ago and think it has been going on too long, and want something so he cannot just come and decide to take her back. One last thing , the judge appointed an attorney to find him and she advised that if we do not pay her fee by a certain date that she will not close our case and notify the judge that she cannot find him, can she do this?
