I have been in a relationship (off and on)for 12 yrs. We have been divorced for 10 yrs now. Six months ago we called it quits - for sure. My son, born after the divorce, is now 6. His mother has a daughter from a previous marriage who has decided to go live with her previously estranged father. Recent events have caused me to believe that the mother is willing to move nearer to her daughter. The distance is not great, but inconvenient. I have been giving money to his mother for support (I have cancelled checks as proof). All has been in mutual agreement. This move is not! What rights do I have to prevent her from moving? I don't believe it is healthy for my son to be around his sister. Should I file for a restraining order on his behalf?
Should I file for custody? My circumstances made it more convenient for him to live with his mother, but I am willing to modify them to prevent this move.
Should we go to court to establish child support?
Please help with any answers. Thanks.

It sounds like you have no court orders regarding this child.
Therefore, his mother can do whatever she wants.
I would strongly urge you to immediately begin voluntary paternity. This would set up visitation, child support, health insurance and could restrict the mother to a geographic restriction.
