father's rights to son

TX. I'm 32 and my wife is 26. we've been married for 6 yrs. We have a son who is 4 yrs. old. We have never fought & we never had problems. To my surprise , she announced she wasn't happy and began acting distance towards me . She's been seeing older man who is 48. She confided in someone that she is not attracted to him but he has lots of money. We're getting a divorce. My question is - what are my chances to gain custody of or son? I've been informed by several people including my atty. that the fact that she commited adultry and has been seen with this man in public even though our divorce isn't final; My chances for custody are next to none in the state of Tx. Is this true? What are my rights? What are my options? I will appreciated any suggestions.

All of your questions are legitimate and reasonable ones, but you should be asking these of your attorney -- that's what you are paying for. If you do not feel comfortable with the attorney, get a new one. If you are getting bad advice, get a new lawyer -- if the lawyer is giving you good advice, that you don't want to hear, then you should stay with that lawyer. He/she is doing you a good service.

A custody fight involves MANY issues of varying importance, and your attorney familiar with the case is the best source for answers.
