Legal Question in Family Law in Texas

Father's Visitation

Mother was given Sole Conservatorship with Visitation alloted to the Parents of the Father who can relinquish their designated weekend to the Father by giving Mother 24 Hours notice. Father is now estranged from his Parents and wants to visit his Daughter on the Assigned weekend but no notice from his parents(he doesn't want them involved). He has not paid Any Child support or Medical ever even though it was court ordered. Daughter has no real interest in seeing Father. She is 4 and he ''stole'' her from mother for 15 months. Should Mother Let Father see the Daughter even though no notice has been given? Texas was the Court-order, Even though Mother and Daughter Live in Alabama

Re: Father's Visitation

I am not completely clear on what the father's visitation is according to the Final Decree of Divorce. I encourage you to follow what the Final Decree states. Otherwise, you can be held in contempt of court.

If father has not followed the Final Decree regarding child support, he can be held in contempt of court.

Since you have moved out-of-state, you might consider asking the Texas court to transfer the case to where you are living now. Be advised that the new court might decide to amend the Final Decree. Therefore, talk to an attorney in your state before you decided what to do.
