Fax copy of notarized document

Is a faxed copy of an affidavit for an increase in child support legally binding? Or would the custodial parent need the original copy?

Re: Fax copy of notarized document

If your question whether a fax is as binding as an original, the answer is sometimes. The original document is always the 'best evidence'; but there are times when a faxed copy is admissible evidence.

If your question is whether an affidavit to increase child support is enforceable, the answer is no. Child support is enforceable only by court order, and without a court order increasing child support, there is nothing to enforce.
