Legal Question in Family Law in Texas
My fiance has 2 children with the children's father. They were never married, never filed a custody and visitation order as well as a child support order with the court. The children's father doesn't work and lives with his parents. He also doesn't pay any child support for the children. The children are 7 and 5 years old. The children reside and are under the care of their mother. The children do go see their father approximately 2 days out of the week. My fiance and I want to be with each other and are planning a move, to move her and the children to California where I reside so that we may be together. Is there anything that my fiance and I should do prior to moving or can she simply pack up her stuff and make the move? Thanks for your help.

I would consult with a family law attorney in the county that your fianc� Lives in. Your fianc� is free to live forever she would like to live but usually the children are restricted to the County and contiguous counties that they have lived there. But only after consultation with an attorney will you know all the facts of TX Law.
Or you move to CA and pray he does not file any paperwork with the texas court for 6 months. After 6 months texas loses jurisdiction.
