Legal Question in Family Law in Texas

What can my fiance do to protect his son if his ex-wife, the custodial parent, is smoking pot around him and bringing him to the house of her drug dealer on a regular basis, who is also married to her sister? What proof do we need and what actions can we take to protect him? Will an at-home drug test showing marijuana in his system be proof enough to get a temporary order changing custody?

You would file a motion for modification that asks for temporary orders, and ask the Judge to order drug tests NOW. Don't bother with at-home drug tests.
