Legal Question in Family Law in Texas

My fiance has visitation rights according to do the divorce papers. However, we have the 3 year old most of the time. We get him from 5-8 everyday and every weekend even though the divorce papers say we would only get him on Thursdays and every other weekend. We both work full time and pay our bills and buy him the things he needs, while the mother doesnt work and only lives off the child support. If we document this and take it to court is there reason to believe it will help us gain 50/50 custody? Would it help in changing how much child support we pay?

This is a tree up which you shouldn't bark. The court isn't likely to give you any special consideration for keeping the child the extra time, either in the form of (1) changing the child support amount or (2) changing the custody to 50-50.

Why not ask the Mom to compensate you for the 5-8 weekday babysitting? A daycare center would certainly charge her. Find out what after-school daycare costs, and tell Mom you'll charge her half that amount. Tell her she can give you a check every Friday.
