Legal Question in Family Law in Texas

my fiance's son lives with his mom, she has custody of him. we have the standard visitation and he pays child support, however about 4 weeks ago his son whom is almost 7 has been informing us that his mom lives with her new boyfriend and has left him to live with grandma and grandpa, and he hardly ever sees her. his dad has lived at the same house for 6 years while mom has moved several times, we have a stable home environment and he chooses to come to our house every weekend, can we go for custody on the grounds that mom"abandoned him", also he missed a week of school at a private school due to mom failing to pay tuition and we have proof of it. also living at grandma's is an uncle whom just got out of the state pen has a lengthy rap sheet of burglary to drug possession whom lives at the residence with the child?

It sounds as if you have grounds to ask for a change in custody.

Mom will fight you.
