Regarding fight for custody

My husband & I are about to embark on a fight for custody of his 12 y.o. daughter. She is with us for the summer.

The mother has 3 children, all by different fathers. The latest husband divorced her & won custody of the youngest child. The father of the oldest child is now seeking custody.

TX CPS called us today. They wanted us to be aware that they are investigating the mom. She will not work, & calls us every month begging for money for food, in addition to the child support we pay every month. The house is a disgusting mess. She is apparently gambling away every dime they have, meeting men she meets on the internet & asking them for money (the CPS worker told us all that). She is confident that they will be taking away the children, and advised us to seek custody NOW, otherwise the children could be in foster care for up to a year if taken.

Would we need an attorney in MS or TX? And we are not wealthy people, and cannot afford high attorney fees. What are some legal aid recourses in TX (or MS, if that is what we need)?

He does not have set custody or visitation rights, so we cannot just keep her & not send her back.

Where in Texas are the children/mom located?

Is this the same place they were living after the divorce?

How long have they been living there?
