Legal Question in Family Law in Texas

I am trying to figure out how to go about changing my 5 and 9 year old sons last name to mine. I have a court ordered protective order against their biological father. We were never married but his name is on the birth certificates. He is in jail now and has not seem them in over 2 years.

File a petition for change of name for a minor child. The dad will have to be notified and may contest the change, but you will be able to explain to the court why you think it's in your children's best interest.
