How do I file a motion for custody
I think when I asked my question yesterday someone might of mis understood and It was not clear. I am not looking for someone to rescue me! I am looking for legal advice. Mabey someone can walk me though on how to file a motion for me to go back to court.
As I stated before I was told when I was independant or back with my parents I could get my son back by writting a letter to the judge. I did that and was told I have to file a motion. So question?
HOW do I file a motion?
Please Do not say I need a lawyer because I know that. Nor I need a sec job because I have one but I also have a daughter that with a sec job daycare takes up alot of money. Leaves me no time for her. I am not looking for handouts just some advice not smart comments because you only know what I write here and not the whole case. Thanks for your time

This is probably not something you can do by yourself. You really do need an attorney. Have you checked to see if there is any "legal aid" in your area.

I'm sorry you got "smart comments" yesterday regarding your questions. If I was one of them, I apologize. If I wasn't, I could have been. First, a lawyer cannot tell you how to do legal work. It is unethical for us to do that. So, I am pretty sure that no one on this website is going to tell you A,B,C,etc. how to file for custody. Besides the "legal aid" suggestion that you have received, you might check with your local county bar association (should be in the phone book). Where I live, we have a community outreach program for pro bono service (where some young attorneys - and some old guys like me - take one or two cases a year to satisfy our pro bono requirements. You might also check with law schools in your area to see if they have student clinics to assist you. Some women's help groups are also active in this area. But, what you're asking is a lot more than is usually offered. Good Luck.

Go to the Harris County law library that is located in the jury assembly building in downtown Houston. It's close to the corner of Congress and Fannin and/or San Jacinto.
There is a set of books - TX Family Practice Manual - with samples inside.
You can also try the following places:
1. The law schools in Houston -
TSU, UH and South Texas College of Law and see if they will take your case.
2. Houston Volunteer Lawyers Program at 713.228.0732.
3. Lone Star Legal Aid - I don't know the number.
I can't think of any attorney that will give you legal advice based on the limited information you provided.
It would be irresponsible and unethical to do so.
