Legal Question in Family Law in Texas
I need to file a motion for a new trial today so I can appeal the OAG case I went to court for on June 30th. The OAG said I was $860 in prepaid. I showed them that I was thousands prepaid and they put two deposits into my SSA account on May 13th and May 3rd and said they did not and the judge said this was between me and social security. Social Security told me that the funds were a refund of child support. Also the judge said that the $860 prepaid could be credited towwards any unpaid medical which my daughter has none she is on Medicaid. The OAG now says I have zero prepaid and I am sure they paid my prepaid to the aunt. I want to file a Motion for new trial but only have today to do this. Can't I just do a quick document and say something to the items above?

It may be too late to respond, but you waited until the last minute. You should be asking a local lawyer to look at your paperwork and give you some guidance. It has been my experience that the OAG has paid overages to the wrong payee. They always have a reason, but nonetheless, they sometimes pay the wrong person. Hopefully you filed enough to protect yourself, and maintain the court's jurisdiction. Now you should see an attorney to determine if it needs to be amended. Even if you want to represent yourself, paying for a consultation, may be enough to get you on the right track.
