Legal Question in Family Law in Texas

I just filed a criminal report on my boyfriend (now my ex-boyfriend) for assaulting me and choking me, and I know in the state TX the choking is a 3rd degree felony so he will be serving a sentence between 2- 10 years. What can I do with his belongs which are in my apartment?

First, he could get probation. The case could get dismissed. The case could be reduced to a misdemeanor.

If the apartment is in your name only, you can pack his stuff and contact one of his family members to deliver it to them for safe keeping. If there is anything of value, you should make a list and have the person sign acknowledging receipt. You should also take a photo of all the stuff you pack.

If he does not go to prison, you may have to take action to legally evict him if he won't stay away. However, there should be a protective order keeping him away for 61 days, and you can ask the DA's office to get a 2 year order.
