Legal Question in Family Law in Texas

I filed for divorce in brazoria county myself no lawyers involved and was just wondering if I could give the petition for divorce to my husband myself or if I needed to do legally and if so how do I do that. He is willing to sign and answer form he is not contesting the divorce.

Your husband can sign a waiver of service that will allow you to just give him a copy of the petition. The law library at the courthouse may have family law books that contain the waiver of service form you can copy and use.

You will need to give him a Waiver of Service to sign before a notary that says basically he approves and is not going to contest the divorce. Once you have that and file it with the clerk, then the rest is easy. The language of the waiver can be tricky, so make sure it says what you want it to say.

After the Waiver of Service is signed, you still need to file a File Decree of Divorce. Then you need to stand in front of the judge and read a statement under oath asking the judge for a divorce.

If you don't know what to do, I sell a DO IT YOURSELF DIVORCE KIT for Texas residents.

It was designed for Harris County residents but it should work in Brazoria County too since it's located in Texas!
