I have filed for divorce and the only contested matter is the custody of our daughter who is 7 years old. I am seeking "Termination of Parental Rights" for several reasons. First, my ex has not paid any money toward the daily cost of raising our daughter in 4 years. In other words, we have not received a dime of assistance in 4 years. Secondly, we are filing based on abandonment. Lastly, and most importantly, our daughter made allegations of sexual abuse against him 4 years ago. While there was no penetration ( making scientific eveidence impossible ), we have had her seen by a child psychologist who has affirmed that she believes that our daughter was sexually abused. We also have affidavits from teachers, her friends' parents, and her psychologist saying that our daughter has spoken to them about the abuse and has demonstrated signs of sexual abuse in her behavior. We have hired an attorney, however I was wondering what our chances of success with "Termination of Rights" will be.
