Legal Question in Family Law in Texas

I filed for divorce on July 1, in Texas. The first hearing was July 18. I was granted temporary full custody of my daughter. My soon to be ex wife filed in California on July 18. She didn't attend the hearing. Can I take my court order and go to California and pick up my daughter?

It's impossible to tell you since you did not include enough information. I assume you had an attorney for your temporary order hearing. So call your attorney and talk to your attorney.

There are rare circumstances where Texas would not have jurisdiction over your spouse - such as she had never set foot in the State of Texas and therefore TX has no jurisdiction over her.

If so, then you will have to go to CA to litigate your divorce.

If you don't have an attorney, you need one - may be two -- one for Texas and one for California.
