I filed divorce in 2001 and seperated from my wife.The Judge ordered my wife to pay her own attorneys fees. She did not. Her attorney withdrew. At the time we had one child. My wife was granted custody. However, she lost custody by CPS for abuse.I was not implicated.After another child was conceived during a attempted reconciliation in 2004 I was incarcerated on a theft charge.I was released in December 2008. My mother-in-law has custody of both children. I was ordered to pay child support on my first child my wife was too. She does not pay.There has been no court order for child support on my youngest child.However, my mother-in-law and I have worked out support issues, etc.My wife has since abandoned my kids and myself. Her residence is unknown. She has a drug addiction. Can I legally divorce my wife under these circumstances?

Yes. You file a divorce petition, and serve Mom by publication. At the final hearing, the Judge will appoint an attorney ad litem for Mom. You will be asked to tell the Court all about your efforts to locate Mom.
