Legal Question in Family Law in Texas
I filed for divorce from my wife back in Dec and it was final on March 20th. I got the kids in the end, but she got her visitation time also. She has only seen the kids 7 times during the whole summer and she never wanted them for the month of July like it says in the final decree. Also in the final decree it states that their can be no firearms around the kids. Her new boyfriend is crazy about guns and did not put them up when my kids came over. I called him to tell him that the kids can not be around that and he said ( those are your rules and the courts rules, but this is my house and I don't have to follow those rules. ) My questions are what can I do about him and the guns and can I do anything about her not coming to see the kids? It's only hurting the kids for her not seeing them. Do I have to hire another lawyer to get something done about this?

Unfortunately, you cannot make a visiting parent visit. Also the boyfriend is correct, he does not have to put the guns up in his house. It is also true that mom does not have to bring the children over to his home. In fact, if the decree prohibts the kids from being around firearms, mom is violating the decree by bringing the children around guns. The conversation about the guns needs to be with mom, not her boyfriend.
