Legal Question in Family Law in Texas

I have filed for a divorce from my wife and I have our 16 month old daughter. She is living with a married man and is preganet by him. I asked for full custody of my daughter and that she can visit her, but she can't take her out of the state of Texas. She didn't sign the papers or show up to court, can she take my daughter from me, or do have the rights to tell her no. Do I have to refile the paperwork to get a divorce.

If your wife was served or waived service, did not file an answer and did not show up on the answer date you ask for get a default judgment from the court. You should speak with a local attorney or legal aid service to help you with the paperwork.
