Filing for custody

I have an existing agreement with my ex. I signed this aggreement at his lawyers office when me ane my husband were having problems. Later my husband moved from Ga to Tx to find work to support our family. I notified my son's father of the move and at first he was fine stated we didn't need to go through his lawyer any more. I moved and then starting receiving harassing phone calls times were tough and we could not afford our phone so it was disconnected. My ex was provided with the house phone number and my address. He never wrote. Then a few days ago an investigator started looking form me. How do I file for custody in Texas if our agreement was in Alabama? There are some things I will never put my child through but I have to file for full custody. I feel if my ex has custody my son will follow his footsteps. My ex has been arrested twice, once for underage drinking and the 2nd for fighting in a club. He also has money and ties in vietnam if he were to have my son visit he could flee the country easily. I know he has done drugs in the past. He showed me a whole new side of how people live. I cannot let my son see him. Me and my husband reside in Tx and wish to continue liviing here. thankyou

Is your son with you now? If you file for divorce in your home county, that court will acquire permanent (practically) jurisdiction over the custody case until your child reaches 18 years (or until it is properly transferred). I don't know what kind of agreement you have in GA or whether it is enforceable in TX.
