Filing for custody and signing over rights
my two 2nd cousins were voluntarily placed with my sister by Texas CPS because their mom tested positive for drugs and the dad (our cousin) had a open CPS case at the time...this was 6 months ago and the kids call my sister mom now...dad is wanting to sign over rights because he knows he cant provide the same way my sister can...but mom wants to get the kids back after not wanting them and failing drug tests this 6 months....we are wondering how to go about getting the dads rights signed over and file for custody without having to pay much because hings are very tight for them right now! Any Suggestions?

Your sister can start by telling dad that HE needs to hire a lawyer to terminate his parental rights. When parents are legally obligated to support the children, courts rarely let one parent off the hook, unless another person will step up to provide for the children. If your sister has conservatorship rights over the children, then it might work out. If he wants out of his obligations, make him pay to do it.
