Legal Question in Family Law in Texas

Filing of Guardianship Papers

I would like to know if I can file guardianship papers with the District Court without the assistance on an Attorney? I already have Managing Conservatory of the Child and they were signed by the mother but the papers were drawn up in a lawyer's office and notarized but nothing has been filed in the court. It should also be noted that the child is not a blood relative of mine but her mother is incarcerated in the Texas Department of Corrections and is not scheduled for release until 2004. I want something a little more substantial than a notarized piece of paper but I can't afford legal fees.

Re: Filing of Guardianship Papers

Have you checked with your local county bar association for a pro bono project? Many county bar associations support these efforts. If you want to do this by yourself, you'll have to obtain an up to date reference volume and follow the instructions. This can be very risky for you if you are not very, very careful. Unless the papers you have for the child have been signed by a judge, I question whether or not you have "legal" custody.
