Legal Question in Family Law in Texas

I was filing with my husband for divorce using the same attorney. He filed and I was the respondent. I never signed a waiver. Nothing was filed but the petition. Is this grounds for a non suit dismissal in texas. And if so how soon can I file again for a divorce?

There is no such thing as grounds for a non-suit. A party can non-suit his or her case at any time. If you file a counterpetition before your spouse files a non-suit, that will keep the case alive. If your spouse files the non-suit before you fike your counter-petition, you can file your own petition right away.
