Legal Question in Family Law in Texas

I am filling out SAPCR paperwork. My husband and I are trying to adopt his grand daughter, whom we have had since birth. I'm filling out the paperwork and the first page asks for petitioner information. Since we are both petitioning, should I fill out 2 sheets with both of our information? The second part is that the birth father is not listed on the birth certificate. Do we need to list him as a respondent and get him to sign our papers? This in the state of Texas.

A SAPCR will not get you an adoption. A SAPCR will get you legal custody of this child.

The birth father needs to be served with paperwork. The court might want DNA testing to determine who the legal father is so that child support can be established.

Since you are both petitioning, then include both names.

I think that you will need a family law attorney to help you with this matter. If you are trying to do a termination and adoption, you will definitely need an experienced family law attorney. Custody is easier but many judges like people to have attorneys because these cases can get complicated. For example, you don't get a hearing in front of a judge without everyone being notified and you will need to get permission of the court coordinator for a hearing in front of the judge.

I recommend attorney Patricia Bushman at 713-807-9405. Or look on this website and on www.avvo.com

I only mediate these days. If you need a mediator, let me know.
