Legal Question in Family Law in Texas

After finding out my husband has been seeing someone, I confronted him and he moved into a local apartment the next day. Well I still had possession of our credit card, his credit card. I went out and maxed it! I agreed to pay my debt off in mediation. Well I have been unable to make the payments the last few months due to hard times right now. Now his lawyer is trying to put me in jail for contempt, fraud. Well we have a court appearance soon and I dont know what steps I should take. I dont have the money to catch up the payments right now, Please let me know what steps I should take if any. Any advice?! Thanks!

There is no contempt in Texas for failure to pay an ordinary debt, even if you are "ordered" to pay it (with a few very narrow exceptions). You can read about it in chapter 9 of the Family Code.

If you don't have a lawyer, you need to consult one soon.
