Forced Adoption?

my son's girlfriend just gave up their baby for adoption even though we would have taken him. Does he have any chance of winning custody? She is only 16, but told him she was keeping baby. What can we do?

Your son's parental rights cannot be taken from him absent notice and a hearing. However, rights not asserted can be lost. You should contact an attorney immediately and proceed to obtain custody of the baby.

Before an adoption can occur, your son's rights will have

to be terminated. He will have an opportunity to fight the

termination. However, he will have to answer the suit or

bring his own suit. If he does nothing he may end up

terminated. Generally, relatives (i.e. grandparents) are

preferable adoptees as opposed to unrelated parties, however

again they must assert their rights in court. These cases

can be complex, so I recommend you hire an attorney quickly

and direct him to assert your family's rights.
