A motion for new trial has to be filed within 30 days after the judgment is signed. You'll want to read Rules 320 and 329b of the Texas Rules of Civil Procedure.

A motion for new trial is in substantially the following form:

-----------------------------------------------

MOTION FOR NEW TRIAL

TO THE HONORABLE JUDGE OF SAID COURT:

COMES NOW , herein and, pursuant to Rule 320, Texas Rules of Civil Procedure, moves the Court to set aside the judgment signed on in this cause and to order a new trial, and as grounds therefor would show the Court as follows:

1. A new trial should be granted because . . .

WHEREFORE, requests the Court to set aside the Judgment in this cause and order a new trial.
