Legal Question in Family Law in Texas
my friend is going through a divorce. He has had relationships since the split and the filing of the papers but was faithful throughout the marriage. He is about a week away from his final hearing. If his soon to be ex-wife found out about one of these relationships could she use it in the divorce trial. There is no written proof of theses relationships but just hear-say.
1 Answer from Attorneys
Probably not. Infidelity is most interesting when it is the REASON the couple is getting divorced.
There are two ways she could use it though:
1. If he has taken his girlfriends out to dinner, to a movie, for a cup of coffee, his wife's attorney will try show that he has been wasting community assets on a girlfriend. With that, his wife's attorney will try to get some reimbursement or other form of compensation back to his client.
2. There are some courts, on in particular in Collin County, where the judge will hurt you bad if he finds out about infidelity at any point. So beware of judicial proclivities.
Lack of written proof (whatever that would be) is not necessary to allege and perhaps prove infidelity.
