Legal Question in Family Law in Texas
I have a friend who is divorced and he ex husband has visitation rights for every other weekend only. It was revised so that the holidays were not included in the visitation order. Her ex took the children on Christmas Eve and was suppose to return them on that Sunday. He refused to return them, even called the police, filed reports while the police (city and county) gave her the run around about how they cannot get involved. Needless to say he finally returned them a week later after his appointed return date. Can she get him for kidnapping? and if not why?? He took the kids and then kept them while being in contempt. then if she can how does she go about this?
