Legal Question in Family Law in Texas

A friend of mine was in prison for several years. During his incarceration his wife became involved with his brother. He has neither seen nor spoken to her in over ten years. They have children together. He is wanting to get married to his current girlfriend. However he is not sure what process he should use. They both live in separate states. I told him to file a divorce based on abandonment of their marital agreement. However, I am seeking advice on what the best process for him would me.

If he's still married to one woman, he shouldn't marry another woman. That's a felony called bigamy.

He should divorce wife #1 before marrying wife #2.
