Legal Question in Family Law in Texas

Frozen Bank account

When I left my husband he froze a savings account that I had in soley in my name. His attorney dropped his case, so he no longer has one. Neither of us have proceeded in the divorce. I have the children and need that money due to christmas. The order I got from the court said that I could access funds for neccessities. The bank said that they have one that sayd I could not access it whatso ever. My husband said that it was suppose to be a temporary freeze for 3 months. Well, it's still frozen. I don't have money for an attorney. What can I do to get it unfrozen? Do I call the Judge that signed the order? How long does it take to unfreeze? Can that be done? My son's b-day is this month as well as x-mas? Please help me.

Re: Frozen Bank account

You need to talk to someone in the legal dept. at the bank and determine what sort of document they want in order to release your money.

If you are talking to a bank officer, you probably need to be transferred to someone in their legal department who is an attorney familiar with Texas law.

If the divorce has been dismissed, then you will need proof that the orders are no longer applicable to you and that the temporary orders have gone away.

If you want to talk to the Judge, you will need to set a hearing where you and your husband (and your attorneys) will all be present and ask the Judge to release the funds.

If you don't have legal counsel, you need to hire someone.
