Legal Question in Family Law in Texas

getting full custody

my husband is wanting to get full custody of his 2 boys and he already has primary joint custody. his ex wife has done a lot of things in the past to prove that she is unfit as far as being mentally unstable and also substance abuse. she has raging bi-polar syndrome, schizophrenia, ocd. she has threatened to kill the kids while they were married. this has been 4 years ago. cps has been called in at her residence recently and her mother got her daughter (the boys half sister) taken away from her and ruled temporary custody to the grandmother. the ex-wife's boyfriend is a drug addict and can't hold down a job and so is she. he beat her up a few weeks ago and the police could not find him. she went to the hospital and had a report done but did not file charges. now he is living back with her at her moms house. there are numerous people including the ex-wife's brother and wife who would vouch that she has done these things. what chances do we have in gaining full custody of the kids? the haven't been alone with there mother for 5 months now and not allowed to go with her. she doesn't have transportation or a job either. hasn't paid child support since may. i need some advice.

Re: getting full custody

Sounds like a good case, but all these things are mere allegations unless they can be presented in proper evidentiary form to the court. If you want to be successful in what you want to do, you should hire a lawyer to work on this for you. These things can sometimes cost some money.
