Legal Question in Family Law in Texas

I have a full power of attorney my husband signed on June 5,2012.Can I legally remove his name off the dead to the house we own? Or can I put the house in someone else's name? He left me over year ago and I don't know where he is.The reason he gave me the full power of attorney was because he said he didn't want to have to deal with anything. He stopped financially supporting me so I'm the one paying the taxes and insurance on the house. I can't afford a divorce on my small salary.He's a gambler and I'm worried I might lose the house.

No. Removing him from the house would be a violation of the duties you undertook as his agent or attorney-in-fact. It's basically fraud and you would face the prospect of serious trouble.

The best thing to do is get a divorce. Check out the Texas Supreme Court's divorce form package. It will guide you through doing most of it by yourself.

The best way to get a divorce under your circumstances is to find an attorney who will just draft documents for you while you do all the leg work. We do that for people all over the state and it costs them a lot less than a traditional, full-representation divorce.
