Gaining custody

The mother of a child is placed in jail. At that time, the children are taken into custody by the state. My friend took a legal patnernity test. However, He has yet to recieve the child. On Dec. 1, the courts claimed he would have to present in court again. Why has he not yet been given custody of his child. He did not do anything wrong or participate with the mother. Why are they holding it against him not to recieve his child?

Obviously CPS is involved.

He does not automatically get the child. Now that a court responsible for a minor child, the court wants to make sure that he is a stable and good parent. For example, he might be a registered sex offender or addicted to drugs.

He really needs an attorney.
