Legal Question in Family Law in Texas

I gave allowed my son to relocate from Texas to Oregon to finish the school year with his father. His father is not able to enroll my son into school since he is not the custodial parent & wanted me to sign a notorized paper giving his father all rights to his educational decisions living me not even able to check on how he is progressing unless his father says it is ok. I am not willing to sign any rights to my son to anyone. It has been almost 2 weeks & my son needs to be in school, I am planning a trip to Oregon to get him I am wondering what proof do I need to pick up my son if his father is not willing to give him to me & we have no court order or child support. Thanks for your help!!!!!

If you have no court order, then either parent listed on the birth certificate can have possession of the child.

If there is no court order then I don't understand why Oregon won't let the father register the child.

You can call the local police before you go to Oregon and make sure that you have everything that they will require in order for you to pick up your child from the father if he refuses to release him to you.

You might need to consult a family law attorney in Oregon. Look on this website & on www.avvo.com for an Oregon attorney.

I hope this information has been helpful.

After 6 months, the child's residence will no longer be Texas and the case (if there is one) will be handled in Oregon. You probably also need to consult with a Texas attorney in your area too.
