Legal Question in Family Law in Texas

I have a geographical restriction to Dallas county. My ex and I have two girls. He is the non custodial parent. He left the county almost 3 years ago and lives over 200 miles away.

I have since remarried and have a child. My husband works overseas and wants us to join him. According to my divorce decree the restriction has lifted because the NCP left the county. I have been advise to still get permission from him or the court. He refuses to allow our move. He does not financially support our children and has not worked in 3 years. My husband is having to maintain two households. What is the best way to win favor of the court?
