Legal Question in Family Law in Texas

Gift

I received a gift from my parents. I'm separated but not divorced. I'm told that in Texas,this is part of community property. When I go to court,should I say is a gift or an advance to inheritance? It is a down payment for a house of $30,000. Thanks for your help.

A gift is separate property -- and there is no such thing as an advance of inheritance. Inheritance does not exist until a person dies. Does your lawyer know you did this? If you were my client I would tell you to give it back until after the divorce. You may end up spending your gift on attorney fees to protect the gift.
