Legal Question in Family Law in Texas

My ex girlfriend is 7 months pregnant and I want the baby to have my last name but i dont think i will be there for the birth because we live in different cities, is there anything i can do about that? And then secondly when is the best time to file for full custody of my baby?

You need to immediately talk to a family law attorney in the county where the child will be born.

Also, you need to file with the State of Texas declaring that you think that a child is about to be born that you believe to be your bio child. There is a form that you fill out and submit BEFORE the baby is born. I cannot remember its name. Call Austin or check on the internet for the form and where to file it.

After the baby is born you can file a voluntary paternity action asking for the child to have your name and to discussing custody. A DNA test will need to be done.
