Legal Question in Family Law in Texas
Give legal gaurdianship to non-custodial parent
I would like to know information regarding voluntarily terminating parental rights. I have one child that lives with her grandmother and grandfather. The mother of the child (I am unsure of where she resides) left almost a year ago (Sometime in early March of 2006, and was residing with the child and mother and father) from the residence without the child (everyone was unsure of her whereabouts..possibly abandonment) she was on drugs but not to an extreme extent. It was not until recently (a few weeks ago) that I received papers for the Child Support Review Process. I spoke to the grandmother and I was informed that she stays on her own somewhere. When I spoke with the grandmother (whom has full non legal custody of the child and has been providing the roof over her head for the past two years) she agreed to become the legal guardian or the non custodial parent for the child. I am unsure how the mother of my child was able to file a petition for child support if she does not even reside with the child(ren). Nor, does she support them in anyway. I want to give up my parental rights, I can not afford the child, I don't work and I am a full time college student.

If the mom applied for government benefits, the Attorney General probably got involved to recover the child support. Most judges are reluctant to terminate a parent's rights, unless another person is stepping in to assume those obligations. If the grandparents are interested in pursuing adoption of the child, you might be successful.
