Giving up parental rights

a young friend who is a single mother is going to get married and the father of the child whose name does not appear on the birth certificate, nor has he helped support this child from birth until now, has agreed to relinquish his parental rights. What legal papers should be drawn stating that the biological father has relinquished his parental rights.

Does the mother's new husband wish to adopt the child? The birth father can execute an affidavit to accompany a petition to terminate parental rights. The birth father would not have to appear in court and at the same time the child could be adopted by the husband. Sounds like what you are wanting is a step-parent adoption, which is a routine procedure but does require some paperwork. If you are wanting to have the bio father relinquish parental rights without adoption by the soon-to-be husband, the court may not go along with it because of the loss of potential child support.
