Giving up parental rights/legal adoption
My husband wants to legally adopt my son, his stepson. My son's biological father will not sign over his legal rights, although he does not see him, nor pay child support. Can the adoption still take place even though my ex husband will not sign papers? What rights does my son whom is 12 years old have in all of this. Is he at a age where he can make this decision whether his biological father agrees or not?

If you are willing to hire an attorney, this may not be an impossible situation. The bio dad has to be notified of the proceedings to terminate, but at that point, he may back down. It seems that it would be worth a try.

If you pursue collection of back child support aggressively enough, he may change his mind and allow the adoption.

The day he turns 18, an adoption when both parties are adults are cheap and easy!
You might not want to wait that long but then the bio. father is NOT invoved!
I currently charge $500 for these forms in a do it yourself kit.
