Legal Question in Family Law in Texas

Is there a good possibility that I can get custody of my kids? I have been fighting this for 6 yrs and I think now is my one and only chance. My ex wife has never been there for our children and has always pawned them off on others so she can go do what she wants. I have asked her several time to let me have the kids until she can get straight and she will not. I have called cps several times and they just keep letting her get away with wrong doing of our kids. I am remarried and have been for 5 years, my wife and I have been with attorneys building our case to get custody of the kids. In Texas I know that it is a mother state and they favore in the mothers way. I have had to call the cops and have welfare checks done on her because she leaves the kids in the car and home alone ( 6 years old and 8 years old ). She has moved 8 time and has been engaged 3 time and had 4 other boyfriends. Just recelty she pulled a knife on her boyfriend and stabbed the wall in there home in front of the kids and the tried to cut him. Few days later she drug overdosed suicide attemped and was in rehab, she wrote good bye letters and everything and would have been dead if her boyfriend would not have found her and called 911. I have set a motion to modify custody and will have an attorney is this enough to get my kids out of this womans dangers?

I think you've posted this question a couple of times. I can tell that you are scared.

It appears that you are hiring an attorney - good!

Get witnesses willing to come to court to verify your allegations.

Have friends and family come to court to sit in the courtroom with you. Even if they are not going to testify, they will be there for "moral" support. The judge will know that you have a strong support community behind you. The more - the better.

If you belong to a church, encourage everyone that can to come support you. Then the judge will know that you have a strong community behind you and that everyone is "watching" what is happening in the courtroom.

In one such custody case, one church rented buses for their members to show up. They were on every floor of the Harris County courthouse & even sat outside the courtroom when they could not fit inside the courthouse. The judge definite heard what was going on before she even made it to her bench that morning. Attorneys could not fit in the elevator to appear in court that morning - it was the buzz all over the courthouse! The church members all wore small identical flowers/buttons so that everyone knew there were from the same church. Church members showed up each day for the hearings. The news media showed up. It made the newspaper. The people just sit and read their bibles. They were peaceful and quiet -- but their presence was powerful.
