Legal Question in Family Law in Texas

Grandchild

When my daughter was 14 years old she had a baby boy. She is 19 now and has never took responsibility for him. My grandson has always lived with my husband and I.

My daughter is now in and out of his life, hangs around the wrong crowd, doesn''t keep a job, etc. etc. She stays at her boyfriends house at night but keeeps her clothes somewhere else. We have no legal papers stating that she can't come and remove him from our home, which she has tried on several occasions. His father has never caused any problems and agrees he should stay with us but doesn't want us to have custody or anything taken away from him. This is causing an enormous amout of grief for all invloved. My daughter wants us to take care of him but not to have any amount of rights. Should we seek child custody or guardian ship and what is the difference? What chance do we have of keeping him?

I would file for custody of the child immediately.

Guardianship is a completely different legal process and I advise against it.

We charge a deposit of $990 (includes filing fee and serving the parents fees) then a weekly payment based on your monthly income. We don't flat-rate cases.
